These Terms of Service ("Terms") govern your access to and use of Bhoja Solutions services, websites, and products. By accessing or using any Bhoja Solutions service, you agree to be bound by these Terms.

1. Service Description

Bhoja Solutions provides comprehensive digital services including but not limited to:

• Web development and design services
• Web, email, and domain hosting
• Website management and maintenance
• Artificial intelligence integration and consultation
• Blockchain and Web3 development
• Mobile application development
• Cloud infrastructure and DevOps services
• UI/UX design consultation

Service specifics are defined in individual service agreements, proposals, or statements of work.

2. Acceptable Use

You agree not to use our services for:

• Illegal activities or violating any applicable laws
• Distributing malware, viruses, or harmful code
• Phishing, fraud, or deceptive practices
• Intellectual property infringement
• Harassment, threats, or abusive behavior
• Spam or unsolicited communications
• Circumventing security measures
• Excessive resource consumption that impacts other users
• Operating unlicensed gambling, adult content, or weapons platforms

Violation of these terms may result in immediate suspension or termination of services.

3. Intellectual Property Rights

Your Content: You retain all ownership rights to content you provide. By using our services, you grant Bhoja Solutions a non-exclusive license to use your content as necessary to provide services.

Bhoja Solutions IP: All code, designs, documentation, tools, and materials created by Bhoja Solutions are owned by Bhoja Solutions, unless otherwise specified in a written agreement. Custom work created exclusively for you may be licensed to you depending on project terms.

Third-Party Components: Our services may use open-source and third-party libraries subject to their respective licenses. We comply with all applicable open-source license terms.

4. Payment & Billing

Payment Terms: Invoices are due upon receipt unless otherwise specified. Late payments may incur a monthly interest charge of 1.5% (18% annually) or the maximum rate permitted by law, whichever is less.

Recurring Services: Hosting and maintenance services are billed monthly or annually depending on your subscription. Renewal charges will occur automatically unless cancelled.

Refunds: Project deposits are non-refundable upon project initiation. Service discontinuation may qualify for prorated refunds of prepaid amounts depending on circumstances.

Taxes: You are responsible for all applicable taxes unless we are legally exempt.

5. Warranties & Disclaimers

AS-IS Basis: Services are provided "as-is" without warranties of any kind, express or implied.

Hosting SLA: We maintain a 99.9% uptime SLA for hosting services, excluding scheduled maintenance and force majeure events. SLA credits are the sole remedy for uptime failures.

Security: We implement industry-standard security measures but cannot guarantee absolute security. You are responsible for maintaining backup copies of critical data.

Third-Party Services: We are not liable for third-party services, APIs, or platforms your site may integrate with.

6. Limitation of Liability

In no event shall Bhoja Solutions be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, arising from:

• Use or inability to use our services
• Unauthorized access or alteration of your data
• Third-party conduct or content
• Data loss or corruption

Our total liability for any claim shall not exceed the amount paid by you for the service in question in the 12 months preceding the claim.

7. Termination

By You: You may terminate services by providing 30 days' written notice.

By Us: We may terminate services immediately for significant breaches (including non-payment for 30+ days), illegal activity, or other violations of these Terms.

Effect of Termination: Upon termination, you remain responsible for outstanding charges. We will provide reasonable assistance in data export (typically 30 days from termination).

Provisions regarding IP, limitations of liability, and confidentiality survive termination.

8. Confidentiality

Both parties agree to maintain the confidentiality of non-public information disclosed during the working relationship. Confidential obligations do not apply to information that is publicly available, already known, or independently derived.

Bhoja Solutions may reference your company name and project type in case studies or portfolios unless you request otherwise in writing.

9. Data Protection & Privacy

We handle personal data in accordance with our Privacy Policy. If you process personal data on our services, you are the data controller and must comply with applicable data protection laws (GDPR, CCPA, etc.).

We will provide a Data Processing Agreement upon request for customers requiring compliance with EU data protection regulations.

10. Modifications to Terms

We may modify these Terms at any time. Continued use of our services constitutes acceptance of updated Terms. Significant changes will be communicated at least 30 days in advance.

11. General Provisions

Entire Agreement: These Terms, along with any service agreement or statement of work, constitute the entire agreement between you and Bhoja Solutions.

Severability: If any provision is unenforceable, the remaining provisions remain in effect.

Waiver: Failure to enforce any right does not constitute waiver of that right.

Governing Law: These Terms are governed by the laws of the jurisdiction where Bhoja Solutions is located, without regard to conflicts of law principles.
